Civil Rights litigation and in particular claims against law enforcement officials for excessive use of force and for other abuses are a specialized area of the law governed in large part by Federal Law. These claims generally difficult to pursue and costly because police agencies are generally well defended, and are often in control of much of the needed evidence. Because law enforcement generally defends these cases strenuously, denies wrongdoing in most instances, and many of these cases are the subject of complex legal pleadings and practice, and often go to trial. Unlike more typical types of liability cases, claims against police officers or agencies demand specialized knowledge, and usually involve the use of expert witnesses.
Federal law provides that a successful civil rights claim can bring with it a separate award for punitive damages, in particularly abusive situations, as well as a separate award of attorneys fees.
